right now at 4:30, arnold schwarzenegger responding the rumors for a potential run for congress. the response tonight from the former california governor. plus weeks after historic flooding hits san jose, some evacuees getting much needed help. but first, a controversial encounter involving an east bay police officer caught on camera. how the community is reacting tonight. >> the news starts right now. good evening, everyone. thank you for joining us. i'm terry mcsweeney. >> i'm peggy bunker. the video of that arrest leading to questions about potential excessive force from the police department. the officer is now on leave while the department investigates. >> nbc bay area laura malpert

has more. >> reporter: this is where it all happened. gas station employees tell me off camera the customer started acting erratically, so they called the police. the video you're about to see does not capture what led up to the takedown. video captured by cell phone shows a vallejo police officer hitting a man on the ground who appears to be resisting arrest. the officer then pulls out what appears to be a flashlight and hits him repeatedly. another officer arrives. you can hear the suspect screaming, i am god. voices in the background are yelling police brutality. people in the neighborhood agree. >> absolutely disgusting that someone would do that to a human being. >> shouldn't hit him tham times. that's extremely excessive. and he's still hitting him. >> reporter: but a store clerk who was working at the time says the man was threatening people. >> at that time he was turning around with his fingers like he was shooting people. i was scared like what if he

really, you know, has a gun on him, you know? and what if he's not there and he decides to pull out a gun and start shooting people? >> reporter: she says the officer in question helped her and many in the past and his actions surprised her. >> i would have never expected him to react like that. i would have never expected him to be that kind of cop. >> reporter: the vallejo police department issued a statement that reads in part, it's important that no one make any assumptions without having all the available facts. just like anyone else, officers are innocent until proven guilty. again, that officer is on leave pending an investigation. reporting live from have a hey althou -- vallejo, laura malpert. we've learned that the victim, a pinole man has died. demarcus doss was targeted as he drove a honda minivan in richmond on thursday.

two teenagers and a man are being held in connection with the shooting that happened on san pablo avenue. the three suspects have yet to be charged. chp investigators believe that one of the teenagers was the shooter and that the shooting was gang related. since 2015 roughly 80 shootings have happened on bay area freeways, most in the east bay. an overnight high speed chase through the south bay, some of the suspects are juveniles. it began around 1:00 this morning in milpitas. they tried to pull a car over for a dui check but the driver took off leading officers on a high-speed chase. speeds reached more than 100 miles per hour. the suspect finally surrendered in front of the s.a.p. the. tense moments at a mobile home park. it started at the friendly village mobile home park. firefighters say when they got there, they saw flames coming from underneath the mobile home.

those flames never did spread inside. the three people living there got out safely. still trying to figure out what sparked those flames. an incredible outpouring of support for san jose flood victims. they're picking up free furniture at a san jose elementary school. marrian favreau is there and getting a lot of reaction from flood evacuees. >> reporter: this is truly a community effort. this morning more than a thousand people dropped off household items for the flood evacuees. let me show you what they dropped off. you can see there are dozens of mattresses as well as headboards and over here couches and chairs, many of the flood victims lost everything. so all of this furniture is badly needed. now, this morning this is a time when the flood evacuees can come to selma olander elementary school in san jose and pick these items up for free. many of the victims lost everything, as i mentioned. i talked to one woman who said

these donations will help her take care of her family. >> it will help me feed my family for the first few months. i got my table for the dining table, i got my sofa. i cannot believe it. because we were worrying about that, where am i going to get the money to buy those things. >> reporter: the family is still living in the vaekation center at seven trees. since she has nowhere to put the donations, u-haul is offering to use this truck for a month to store the items. all the furniture is free for flood evacuees. more than 200 people picked them up today and they will no longer be able to pick them up after 5:00 tonight. so there's a last-minute rush for the evacuees to come here and collect their belongings. what happens to all these things the after 5:00? the salvation army is going to pick them up. right now they're already packing them up. so many flood victims i talked to said that this will help them

start over after they lost practically everything. reporting live in san jose, marianne favro, nbc bay area news. great story, marianne, thank you very much. what a day in the bay area. a lot of people enjoying a beautiful sunday. take a look at the scene over at at&t park. a day like this can get you thinking about baseball and spring. meteorologist rob mayeda is thinking about baseball but also a warm spell this week. >> we're seeing temperatures from belvedere back to san francisco, look at that, 75 degrees right now. downtown san francisco seeing a bit of a late day sea breeze almost like a summer afternoon. 68 degrees after reaching 70 earlier, mid-70s, too, from walnut creek down into san jose. 75 degrees. most locations today about 2 to 6 degrees warmer than the same time yesterday. and typical of what we get in an almost spring or summerlike pattern, you still see low 60s

around half moon bay. 77 in concord. so we've got on-shore winds. along the coast that may bring in a patch or two of low clouds. still got numbers from the mid-40s to start the day. dress in layers. you'll need a jacket probably through about 9:00 in the morning, then look at the hour by hour forecast. for places like san jose you'll see temperatures starting off close to 50, then soaring into the mid-70s by 2:00. a few spots can be closing in on 80 degrees. >> what a difference a week makes. you can track the forecast with our free nbc bay area app. just click on the weather tab, get the latest updates for your neighborhood. house speaker paul ryan and the trump administration are vowing to move forward on their plan to repeal and replace obamacare regardless of what a congressional budget office finds about it. this could happen as both senate democrats and republicans could continue to push back. jennifer johnson reports now

from washington. >> reporter: vice president mike pence spent the weekend pushing the white house and republicans new healthcare plan. >> the obamacare nightmare is about to end. >> reporter: while democrats and the gop squabble over the bill. several republican senators say the house plan is dead on arrival. >> this bill in the house of representatives cannot pass the senate, and i believe it would have adverse consequences for millions of americans. >> reporter: some studies show the plan would leave up to 15 million americans without health coverage. >> i don't understand their political strategy because this is bad politics. deeper than that it's bad policy and bad process. >> reporter: democrats say they're ready to work on a better bill but some doubt the two sides can get anything done. >> i believe the political parties are disintegrating before our very eyes. and the republicans, you need to invite democrats in because we're talking about lives. >> reporter: as president trump

remains in washington this weekend, the house intelligence committee has given the justice department a monday deadline to show evidence of his claim that president obama wiretapped trump tower during the presidential campaign. >> there's one of two possibilities here. either the president quite deliberately for some reason made up this charge or perhaps more disturbing, the president really believes this. >> reporter: the justice department has indicated it will not meet monday's deadline. jennifer johnson, nbc news, washington. one person who has been vocal about the plan to repeal obamacare was barbara lee of the east bay. an emergency town hall in berkeley to discuss neighbors' concerns about the plan. earlier this week the democratic representative spoke out to msnbc about her issues with the plan. the poor and the elderly would suffer the most and that people's lives are at stake with the new health care plan. this was the fourth in a series of town halls hosted by the

group called the fight for our health group. the organization wants to draw attention to the dangers of repealing obamacare. former california governor arnold schwarzenegger is debunking rumors that he's running for senate. in a post on facebook and twitter, schwarzenegger said he's deeply flattered by all the people who approached him about running for the senate but his mission right now is to, quote, bring sanity to washington through redistricting reform. he's been speaking out about gerrymandering, it is completely breaking our system. he believes his desk is in a place outside washington. coming up in "nightly news" a top trump official is speaking out about the healthcare plan and has a surprising stance. that's at 5:30. coming up next, caltrain bringing their vision for the future to washington. the latest push to try to upgrade their system. plus who says you have to wait for summer?

caltrain is hoping to secure hundreds of millions of dollars to upgrade its operations. they spent the past weekend in washington, d.c., trying to convince the federal transportation administration to give them more than $6 million. the agency already has more than a billion dollar earmarked for electrifying the corridor from san francisco to san jose. caltrain says they're optimistic that the money they're asking for fits into the frum administration's focus on investing in infrastructure. football fans from many different teams rally together in oakland hoping to keep the raiders from leaving for las vegas. fans gather at the hilton in oakland. look at all those different jerseys. this is called the fan and community conference. fans of the eagles, giants, bears, cowboys and more came together to show their support for the raiders staying in the east bay. some say the city of oakland and

the raiders are synonymous. >> this is where they need to be. it's so important. i wouldn't want to see the raiders anywhere else. i wouldn't go to las vegas to see the raiders. what's the point of that? i want to see football when it comes here to oakland. >> the nfl owners are set to vote whether they'll allow the move to las vegas. that vote coming up at the end of this month. a taste of spring-like weather continues around the bay. the view mostly clear from tiburon, we'll let you know if the storm in the pacific northwest makes a trip to the south.

the group, it's your district, teamed up with the streets program to host a festival in the mission district. the streets were shut down so people could explore a stretch of valencia. some drummed along the route. summer of love exhibitions, art and activities everywhere. >> i think it was a crucial part of san francisco's history. >> organizers estimated 20,000 people came to the event over the course of the day. another 2017 street festival is set for the spring and the summer all centering on the haight-ashbury phenomenon. >> how great is that. many now are riding across the bay bridge today because of daylight saving time. the bike path will now be open for an extra three hours, that starts today. the new hours from 6:00 in the morning to 8:00 at night each

weekend but the path will still remain closed during the weekdays as construction continues across the eastern span. >> everywhere we look people in shorts and t-shirts. that's the exact clothesing to be wearing today. >> good pattern. we have these storms coming in every weekend. the bay area we had snow down to 2,000 feet. now the snow and sunshine up toward the sierra. we'll give you the view from the bay area up toward northern california. from the heavenly observation deck and the mirror reflection off lake tahoe. gorgeous conditions in the sierra. about this time last week we had snow flying. right now nothing but sunshine in san jose, 75. mostly sunny conditions around san jose and over to dublin also 75 degrees as we continue our tour around the bay. san francisco 68. we did have a high of 70 around downtown and tiburon there 75 a popular number around the bay area along with mostly sunny

skies. we have a late day sea breeze which may try to push a few low clouds towards the coast. so what we'll expect is to see cool conditions at least for the morning hours, 40s and 50s. about the same amount of warming during the day tomorrow. another chance of upper 70s maybe even close to 80. coastal low clouds make a return appearance on the coast as we head towards tomorrow evening. morning temperatures still a reminder that it's march. you still need a jacket for the morning, by the afternoon upper 70s south of downtown san jose, 80 in los gatos, saratoga, cupertino close to 80 there. as we go about the bay, numbers in the mid to upper 70s at 3:00 in the afternoon around the bay including san francisco you see those temperatures in the low 70s, then slow cooling as we go through the evening. tuesday looks to be the warmest day of the week at least for

valleys. notice hour by hour i think we'll see a few low 80s, maybe even the north bay, but we'll begin to see the seabreeze pick up around the bay and increasing high clouds on tuesday which will set us up at least for a chance we think of seeing a few showers on wednesday. no rain right now, storm tracker continues to stay off to the north, but we're beginning to see this high pressure weaken just enough right there wednesday afternoon maybe into wednesday evening for the north bay. might see a shower or two. then thursday into friday, the high builds back, then our next chance of seeing showers, you see this system here for next sunday, it's going to weaken as it crosses the bay area. all of the futurecast models less than a quarter inch in most of that north of san francisco. so even though we will see two chances of showers wednesday and next sunday, again, rain accumulations nothing like we saw compared to the beginning of the year where we had just heavy rain nonstop moving through the bay area. just brief chances of light showers. san francisco, look at those

every single day 150,000 drivers pass through the east bay caldecott tunnel. >> very few are aware of the wildlife not far above their cars. we see what ecologists are doing to find out just how wild it is. >> reporter: we heard plenty of tales about chickens crossing the road. those stories probably weren't talking about this road. highway 24 at the caldecott tunnel. for many critters, this road has become a crossing of death. >> we've been documenting over the years animals being killed on highway 24. >> reporter: but on the hill just above the zipping cars sits nature's highway. here -- i's supermuddy and wet. >> reporter: in these rain soaked hills of the east bay regional park district, park ecologist steve wondered whether animals were using this crossing which was set aside as open

space 20 years ago. >> it wasn't 100% clear whether or not it was an important corridor. >> reporter: back in december he set up an experiment. >> right where the green moss is that's one camera facing us. >> reporter: on the tree on the hill above the tunnel he installed a pair of cameras. >> they're triggered by motion. >> reporter: anything that moves. >> dead center on the tunnel. the westbound is right under us. that will be fun going down. >> reporter: you can just imagine the first time he trekked down this hill last december to see what, if anything, the cameras captured. >> are you kidding me? that's so cool. >> reporter: but from the first image, bon bobcat, raccoon. >> saw plenty. >> captured deer. >> skunk. >> tail up. >> nine different species. >> the camera unintentionally photographed human mammals. >> somebody's dog, like opening a christmas gift every time we come and check the cameras.
